Terms & Conditions

These Terms and Conditions are made between NorDan Vinduer Ltd. (hereafter to be referred to as “NorDan”) and the person/s purchasing services ("you"). By using our services, you agree to be bound by these Terms, which are governed by the laws of Ireland.                                                                              

  • Windows are priced in NorDan’s Alu-Clad Timber Systems, unless otherwise specified, tested to a whole product U-Value as stated at bottom of our shop drawings.
  • NorDan offer a unique 30-Year Warranty against rot and fungus on all its N-Tech line of products.
    • Note: warranties differ based on product lines, it is at the discretion of you to review warranties relating to your chosen products
  • All glazing is high-performance Soft Coat Low “E” with Argon gas and Warm Edge Spacers.
    • Note: for exact product specifications please refer to your drawings as specifications differ depending on an individual project basis.

 

Please Note:                

NorDan will not be liable, financially or otherwise, for any loss, delays, or failure to fulfil our obligations under this contract if such loss, delays, or failure to fulfil obligations is caused by force majeure, or any other event beyond the reasonable control of the parties. Common examples of force majeure may include, but are not limited to, pandemic/epidemic, acts of God, government action, industrial action, and/or operational disruptions including weather events, war, terrorism, or civil commotion.

In some instances it may not have been possible to provide units in accordance with the architect’s design, and therefore we may have provided for an alternative design compatible with the NorDan system. Final design and details will have to be confirmed prior to placement of any order.       

Prices are subject to the agreement of all details.               

The following items are excluded from the quotation price unless specifically stated:              

  • Mastic pointing.
  • Cladding to Steel Posts.
  • Air-tightness tape.
  • Glass protection.
  • Third-party ironmongery.
  • Pressed-aluminium cills and flashings.
  • Fascias, aluminium trims, and non-standard cills.
  • Structural support of any kind.
  • Craneage or additional Lifting Equipment.
  • Internal finishing to horizontal and/or vertical steel posts of any kind.

 

 

A. GENERAL                                                                                       
  1. This quotation is open for acceptance for a period of 30 days, unless previously withdrawn.
  2. Prices are based on information provided by your form of enquiry only i.e. Bill of Quantities/Elevation drawings/Window schedule.
  3. Please note, only goods and services described and priced for in this quotation are offered for acceptance. See our attached bill of quantities.
  4. NorDan operates a Quality Control procedure, which enables all parties to take part in finally agreeing to the production design, sizes, and quantities before the order is placed.
  5. Unless otherwise stated all goods offered are subject to manufacturer’s standard manufacturing dimensions, profiles, and details all as described in their technical literature.
  6. No structural calculations have been considered and no allowance for reinforcement has been included unless otherwise stated. Please check and ensure that the overall weight and wind loading required for the goods described herein will be successfully transferred to the main structure with standard fixings. If any product requires special fixing brackets or reinforcement that requires preparatory production works such as special rebates or routing out (only) for insertion of steel reinforcement we must be informed before the date of order.

 - All products are quoted to withstand a minimum windloading of 650kN/m2 unless otherwise stated. It is responsibility of designer/ site engineer to provide engineers report if site conditions exceed 650kN/m2.

  1. NorDan reserves the right to amend this quotation due to any changes whatsoever.
  2. For NorDan’s Alu-Clad Products, the purpose of aluminium cladding is to reduce maintenance i.e. painting of the external surface. It does not eliminate the requirement for the periodic maintenance that is required on all windows and doors - especially adequate cleaning and lubrication of moving parts as described in the NorDan Operation & Maintenance manual. Such maintenance is essential to the long term functionality and durability of the NorDan products. The aluminium cladding has purpose made gaps to allow for rain water to drain away – this is a fundamental requirement for water-tightness. Windows & doors with a stained/lacquered internal finish will have a small part of this surface visible externally between sash & frame. In rare instances and despite anti-fungal additives in the coating, ‘Blue Stain’ can occur on exposed lacquered surfaces if they are left unattended. This is a surface fungal growth manifesting as small dark blue or black spores. It is harmless and should not be confused with rot or decay. For maintenance on any NorDan product, please refer to the associated maintenance documentation.
  3. For NorDan’s Aluminium Products, the purpose of aluminium is to reduce maintenance i.e. painting of the external surface. Such maintenance is essential to the long term functionality and durability of the NorDan products.

For all NorDan Products proper maintenance is required to ensure optimal function and longevity. Please refer to your specific product Operation & Maintenance Manual for correct procedures. If you have not received your manuals, please reach out to info@nordan.ie. Failure to adhere to Operation & Maintenance Manuals will void your warranty.

  1. Brushed Satin Ironmongery fitted to all units as standard – unless specified in the window schedule.
 
B. PAYMENT TERMS

Payment Terms will be 35 % deposit due prior to ordering and the full balance before delivery to site. Payments will be accepted by EFT only.

Payment of the final balance

  • Final payment must be made one week prior to the provided delivery date
  • Full payment is required and no retention is offered
  • If you do not complete final payment you will not be given an installation date
  • Failure to pay your bill will result in delays to your installation
  • Once invoices are created at time of sale no changes to names, addresses or company can be done
  • All invoices’ issued at time of sale are final

All quotes are subject to change if altered on or after survey stage.

Any build detail found on-site will be an additional cost and appropriate works must be carried out by a qualified professional before installation of NorDan units

 
C. CONDITIONS OF SALE

VARIATIONS TO STANDARD TERMS AND CONDITIONS OF SALE:             

  1. The trading terms and conditions of NorDan cannot be superseded or varied unless recorded and signed by a Company Director of NorDan on its Company letterhead.
  2. By placing an order without consideration of the requirements to address “VARIATIONS TO TERMS AND CONDITIONS” this offer will be deemed to have been accepted by you and will take precedence over any Terms and Conditions stated within your order. This is the condition of sale and takes precedence over any other documents/correspondence
  3. NorDan are prepared to consider entering into a formal Sub-Contract for the supply and installation of our goods. Such a Sub-Contract shall be in the form of a standard CIF Sub-Contract subject to the particulars of the Main Contract and all entries in the Sub-Contract being agreed between us and reflecting the contents of this letter and our Conditions of Sale which are otherwise those upon which this offer of installation is based. Your particular requirements may be accommodated subject to detailed discussion, adjustment to price if necessary, and written agreement.
 
D. ORDER & DELIVERY PROCEDURES

It is not unusual to see sizes and detail change between initial enquiry and final ordering stage. This may result in changes to our price. We will work with you and your design team and/or builder/contractor in order to establish your precise manufacturing requirements. Once goods go into manufacturing it is not possible to alter production details or sizes.

ORDER, LEAD TIMES & DELIVERY DATE:                

  1. Please ask your Sales Rep for up-to-date lead times as these vary throughout the year. Lead times are only an indication and NorDan will not be liable for delays in delivery regardless of reasoning.
  2. Production cannot commence until NorDan are in receipt of the full and final Sign-Off of the order details.
    • Requirements for full sign off:
      • Signed and returned Order of Acceptance
      • Signed and returned Schedule of Quantities for fabrication
      • 35% Deposit paid in full
  3. No changes can be made to the order after final Sign-Off.
  4. Delivery dates are strictly subject to the receipt of the final Sign-Off. Estimated delivery times start when order acceptance, schedule of quantities, and 35% deposit have been received.
  5. The late supply of required information or delays on-site may result in the extension to estimated delivery dates.
  6. All delivery dates are given in good faith. However delays may occur beyond our control that we cannot be held responsible for. Every reasonable effort will be made to ensure delivery dates are kept.
  7. Goods will be delivered on 40ft or 20ft trailers or as appropriate
  8. Goods will be palletised and then shrink-wrapped.
  9. Units to be unloaded within reasonable distance of the works. Note that our price does not include for Specialist Off-loading facilities over and above our standard truck-mounted Hi Ab lifting device. We have not included for on-site Craneage or any specialist Height Access facilities, unless specifically stated in the quotation.             
E. INSTALLATION PROCEDURES                
  1. Installation prices are based on our standard fitting details for windows and doors
  2. We emphasise that any required non-standard fixings or special brackets that may be necessary to raise the structural integrity or performance of any wall opening and any materials that may be required to complete the construction of any openings, are not included in this quotation.
  3. Prior to installation of any NorDan products the openings should be prepared as per agreed installation details. In the absence of adequate details supplied by the building designer (Architect/Engineer), NorDan will require that the main contractor will have adequate structure in place to support all dead and live loads prior to installation commencing. Particular attention is required for door thresholds – NorDan suggested details attached. The client should, in consultation with the building designer, satisfy themselves that these details are acceptable. It is your responsibility to request NorDan suggested details if not supplied, please liaise with your Sale Representation.
  4. Any damage caused to NorDan products by other trades must be made good by main contractor/client. Damages must be noted within 48 hours from time of installation to report any visible defects. NorDan will not take responsibility for damaged goods after this time. NorDan will repair products that include damages that may effect warranty, which is chargeable to the customer.
  5. Under the Health & Safety Act 2005, NorDan must make homeowners/building contractor aware they are solely responsible for the safe erection, inspection, maintenance, adaption and adjustments to scaffolding on site for fitting windows and doors.

    Scaffolding board access must be >225mm from the inner board to the building structure, any gap <225mm is not safe for access and adjustments must be made by contractor/home owner before NorDan operatives can proceed to fit on-site.

    Safe access must be made available for fitters and site operatives to access windows, scaffolding not adhering to Code of Practice will not be permitted for use by NorDan operatives.

    (Code of Practice for Access and Working Scaffolds issued by the Authority in 2009 in accordance with the Safety, Health and Welfare at Work Act 2005)

    Restrictors must be in place on all NorDan windows, Tilt & Turn windows fitted to floor level must always have permanent restrictor fitted.

  6. For New Build/Refurbishment Projects, your contractor is required to have all openings (sometimes referred to as “opes”) prepared and ready before installation is scheduled. Failure to have all openings ready for install and cleared for access on arrival of our installers may results in your items not being fitted on the specified date. If NorDan are required to revisit the site to complete install this will result in further charges over and above the contract amount. An amount of €750.00 per day will be charged to you. This charge is non-negotiable. Return to site will not be scheduled until this payment is made in full.
  7. All sites must be ready for checking 2 weeks prior to arrival date.
  8. New Building Projects/ Refurbishment Projects:  window and door delivery packaging, pallets, wrapping and waste material from the installation to be disposed by main contractors/you   

    Replacement Projects, NorDan will include for the supply of skips for Window & Door packaging, pallets, & waste materials from installation.

Please ensure the site is ready at this stage otherwise a site check cannot be completed. If site is not ready this may delay installation.

 

F. STORAGE FACILITIES      

If the Site is not ready to receive the goods on the agreed delivery date, then the additional storage costs incurred by NorDan will be charged to you.

Storage fees will apply for all units left in our warehouse facilities longer than 30 days.

After 30 days, storage fees are chargeable @ 1% of the overall contract value per week.

This will be charged as an additional invoice.

Please note: warranty starts from products’ arrival to NorDan warehouse facilities. Products will be kept in an operating warehouse as NorDan does not provide a storage specific facility. Therefore, NorDan are not responsible for any damages inflicted during storage.

 
G. VENTILATION  
  1. TRICKLE VENTS:

Trickle Vents can, if requested, be supplied to opening windows above a certain minimum width (488mm).                  

It is important to state however the supply of trickle vents is no guarantee that the ventilation requirements for your project are fully achieved and thus it is imperative that you refer to the table below as a guideline when finalising the ventilation requirements with the architect.            

The trickle-vent is positioned in the head of the unit and has an internal adjustable control. The outside entrance to the vent is concealed within the frame and fully covered by an insect screen.

NorDan's standard adjustable trickle-vent can be fitted to all opening windows wider than 488mm.  

Note: The maximum achievable background ventilation per unit is determined by the following frame widths.

Frame width 488mm – 687mm provides 3906 mm2 Free Area    

Frame width 688mm – 787mm provides 5712 mm² Free Area     

Frame width 788mm and wider provides 7812 mm² Free Area    

Occasionally, external condensation may manifest on the outside of glass. This is caused by so little heat escaping through the window/door that the external pane of glass is cooler than the dew-point and airborne moisture will condense on it. As the sun comes up and the temperature rises the condensation will evaporate. Such external condensation is dependent on weather conditions, geographical location, and site orientation, and can occur on some windows/doors and not on others. Further
